The Delaware State Senate is set to reconvene next Tuesday to consider a House Concurrent Resolution (HCR42).

The House voted along party lines Monday to pass the measure, which seeks State Supreme Court guidance in cases where elected officials face indictments. The Senate had passed a similar resolution (SCR63), but by the time the House took it up many Senators had left after the special session on redistricting.

Lawmakers want clarification of the Legislature’s constitutional obligations under Article III, Section 13 of the Delaware Constitution.

Members of the House and Senate are considering their possible roles in the case of indicted State Auditor Kathy McGuiness. McGuiness has pled not guilty and says she is innocent of all charges.

The Senate session takes place Tuesday at 4:00 p.m. at Legislative Hall in Dover. Seats in the gallery may be reserved on a first-come first-served basis – please CLICK HERE
