Judge Finds for Georgetown & Police Department

Lawsuit brought by two former Georgetown police officers

A Sussex County Superior Court judge has found for the town of Georgetown, Captain Ralph Holm and Police Chief William Topping in a lawsuit brought by two former Georgetown police officers. Superior Court Judge Richard Stokes found that Sean Brittingham and Christopher Story failed to establish that their meeting with a local councilwoman constituted protected activity under the First Amendment. The Court found that Brittingham and Story’s speech at the meeting barely touched on a matter of public concern and there is no free speech claim because the defendants employment decisions didn’t violate the First Amendment.
