Rehoboth Officer Won't Face Criminal Charges after April Taser Incident, but Will Face Deprtment Discipline for Violation of Department Policy

The Delaware Department of Justice has completed its investigation into a taser and use of force incident that occurred in Rehoboth Beach in April.  Cpl Tyler Whitman and two other Rehoboth officers were involved in the arrest of Jeremy Anderson in April.  During the arrest Cpl Whitman used a taser on Anderson and kicked him.  The DOJ has found that Cpl Whitman’s actions while trying to arrest Anderson were not criminal and are not subject to criminal prosecution under Delaware law.   However, Chief Keith Banks tells WGMD that the investigation by the Dover Police Department dealt with whether Cpl Whitman’s actions complied with the Rehoboth Police Department’s Policies and Procedures.  The found that he was in violation of the department’s use of force policy – and the city will take the appropriate disciplinary action.
