In a single-page order, the Delaware Supreme Court has upheld the Sussex County Superior Court’s decision to overturn the Public Integrity Commission’s 2011 ruling against Dewey Beach Mayor Diane Hanson.
The P-I-C ruled that year that Hanson had violated the State Employees, Officials and Officers Code of Conduct when she voted in favor of an ordinance stating that Dewey Beach’s height limit was 35 feet, including in the area of the Ruddertowne complex. The Commission said Hanson shouldn’t have voted because as a rental property owner, she had a financial interest in the matter. Hanson appealed that ruling up to Superior Court successfully last year, claiming she didn’t get a fair hearing, and that the P-I-C had violated its own procedures.
