UPDATE: Delmar Family Granted Temporary Peace Orders Against Man who Set Their House on Fire

May 09, 2013 -- 5:19am

A Delmar family has received temporary peace orders against the landlord accused of setting fire to their home while they slept this week.

A District Court judge on Tuesday granted temporary peace orders against 42-year-old Andy Modeste for all four Machado family members.

Modeste faces charges of 1st degree arson, two counts of 1st degree malicious burning, four counts of 1st degree attempted murder, 1st and 3rd degree burglary and related charges in the fire that the Machado family discovered just after midnight Monday. Eduardo Machado and his wife and their two children, were asleep in their East State Street home when the fire broke out in a crawl space under the house.

A dispute over the landlord/tenant lease agreement is suspected to be a factor in the arson.
